On June 30, 2005, the Twentieth Session of the Hague Conference on Private International Law unanimously adopted a new Convention on Choice of Court Agreements.' This new treaty is now open for signature and ratification, or accession, by all States, regardless of whether they are Member States of the Hague Conference or not. It is hoped that the Convention will do for choice of court agreements (forum selection clauses) and the resulting judgments what the 1958 New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards2 does for arbitration agreements and the resulting awards.
