Tóm tắt

This paper describes a new framework for understanding the doctrine of precedent within the common law system. It addresses two fundamental questions in legal theory: how precedent cases constrain future decisions (the mechanism of constraint), and how a balance is achieved between the constraints of precedent and the freedoms allowed to later courts for developing the law.
